1. Agreement to Terms

By accessing or using ElevateLog ("the Service"), provided by Nelson AI ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

ElevateLog is a cloud-based software platform designed for elevator inspection professionals. The Service provides:

  • Digital inspection checklists and forms
  • Building, client, and equipment management
  • Deficiency tracking and documentation
  • PDF report generation
  • Digital signature capture

3. User Accounts

To use the Service, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and complete registration information
  • Notifying us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription and Payment

Billing

Paid subscriptions are billed in advance on a monthly or annual basis. Payment is processed through Stripe. You authorize us to charge your designated payment method for all fees incurred.

Free Trial

We may offer a free trial period. At the end of the trial, you will be automatically charged unless you cancel before the trial ends.

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial months.

Price Changes

We reserve the right to modify pricing with 30 days' notice. Continued use after price changes constitutes acceptance of new pricing.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Upload malicious code or content
  • Share account credentials with unauthorized users
  • Use the Service to harass, abuse, or harm others
  • Reverse engineer or attempt to extract source code
  • Resell or redistribute the Service without permission

6. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Nelson AI and is protected by copyright, trademark, and other intellectual property laws.

You retain ownership of all data you input into the Service. By using the Service, you grant us a limited license to use this data solely to provide the Service to you.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You acknowledge that:

  • You are responsible for maintaining backups of your data
  • We may access your data to provide support or improve the Service
  • Data may be transferred to third-party service providers

8. Professional Responsibility

ElevateLog is a tool to assist qualified elevator inspectors. You acknowledge that:

  • The Service does not replace professional judgment or certifications
  • You are responsible for ensuring inspections meet all applicable codes and regulations
  • Checklists are provided as guidance and may need customization for specific jurisdictions
  • You must maintain all required professional certifications and licenses

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Merchantability or fitness for a particular purpose
  • Non-infringement
  • Uninterrupted or error-free operation
  • Accuracy or reliability of any information obtained through the Service

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NELSON AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or business opportunities
  • Service interruptions or data breaches
  • Errors in inspection reports or checklists
  • Third-party actions or claims

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Nelson AI and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Termination

We may terminate or suspend your account immediately, without prior notice, for:

  • Violation of these Terms
  • Non-payment of fees
  • Conduct we deem harmful to the Service or other users

Upon termination, your right to use the Service ceases immediately. Data retention follows our Privacy Policy.

14. Governing Law

These Terms shall be governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Texas.
